These general terms and conditions for courses and events ("Terms") apply to all registered participants ("Participant(s)" or "you") for any course or event ("Course") offered on the website www.escmid.org ("Website"), which may take place face-to-face ("Face-to-Face Course"), online ("Online Course"), as a hybrid event consisting of a Face-to-Face Course and as an Online Course, or as a pre-recorded online course available on-demand ("On-Demand Course") (all together "Courses") organised by the European Society of Clinical Microbiology and Infectious Diseases (Europäische Gesellschaft für klinische Mikrobiologie und Infektionskrankheiten), Aeschenvorstadt 55, 4051 Basel, Switzerland ("ESCMID").
ESCMID reserves the right to change, adapt or amend the Terms from time to time at its sole discretion and shall notify registered attendees or participants by appropriate means. The current version of these Terms can always be accessed here.
You can register for a Course through the Website. You can only register and attend a Course if you are at least 18 years old.
Registration is subject to a registration fee, which depends on the Course and your registration category. For further information on the fee for and the content of a Course, please refer to the Website. The payment of the registration fee (in EURO) can be completed by credit card or bank transfer. The registration fee is subject to applicable statutory value added tax or any additional mandatory charges. Once you have completed and paid the registration fee, you will receive a payment confirmation. Finishing your registration and accepting these Terms (including the cancellation policy) constitutes a binding offer. ESCMID will inform you of your admission to the Course upon receipt of the payment by sending you a confirmation email, which constitutes a binding agreement between you and ESCMID.
Reselling or other unauthorised assignment of your registration, not in accordance with the Terms, will void your registration and you or the purchaser of your registration will not be given access to the Course, unless authorised by ESCMID. ESCMID reserves the right to cancel any registration made by any person or body whom ESCMID reasonably believes to be associated with any reselling or unauthorised assignments.
Following accreditation, full payment and subject to completed online-assessment/feedback of attended sessions, you will receive your CME credits by email if the Course is eligible for CME credits. To the extent provided by ESCMID for the Course, the certificate of attendance is available onsite or online.
To access a Face-to-Face Course, you might be asked to present a valid identity card or passport, or any other document or confirmation required by law.
To attend an Online Course or an On-Demand Course, you must have in place the necessary infrastructure (e.g. internet access, internet bandwidth, web-conference applications, or any other IT infrastructure). ESCMID shall not be responsible or liable if you fail to ensure the necessary infrastructure and cannot attend the Online Course or the On-Demand Course, even if you have successfully registered and paid the registration fee.
Upon successful registration, you will be granted unlimited access to the respective Face-to-Face Course, the Online Course and/or the On-Demand Course mentioned in the confirmation email, including the materials or other services outlined in the online description and/or the confirmation email. For On-Demand Courses, access to the course content will be granted immediately upon conclusion of the contract.
You agree to comply with all applicable laws in connection with your attendance or participation at the Course. Any use of photographic, audio, video, or other recording equipment to reproduce or otherwise exploit the video presentations, discussions, or other content of the Course that are accessible through your registration is strictly prohibited.
ESCMID will try to make sure that the information for a Course on the Website, such as the programme, scientific sessions, speakers, industry content, abstracts, time, and dates are correct at the time of publishing on the Website, but ESCMID cannot fully exclude that circumstances beyond its control may necessitate substitutions, alterations, postponements, or cancellations to the content, format, themes, speakers, chairmen, timing, or dates of a Course. ESCMID reserves the right to change the time and date of the programme, sessions, speakers, industry content, abstracts, content at any time and will not be liable to you for any cost incurred by you as a result.
ESCMID will try to notify you in due course of any substitutions, postponements, or changes by email. If a Course is postponed, your registration will remain in place for the postponed Course. No refunds will be provided if a Course is postponed.
In event of cancellation of a Face-to-Face Course as a result of or in connection with any severe crisis, ESCMID will automatically register you for the Online Course with the same content, if available, and ESCMID's liability is limited to the refund of the difference in the registration fee, if any. In the event of the cancellation of both the Face-to-Face Course and/or the Online Course or if no Online Course with the same content is available, as a result of or in connection with any severe crisis, ESCMID's liability is limited to the refund of the paid registration fee. In no event will ESCMID be liable to you for any other damage or loss incurred by you as a consequence of such cancellations. The participants can cancel the registration for a Course based on the cancellation policy, which is published on the Website.
Neither ESCMID nor any of the speakers, chairpersons, moderators, or sponsors assign, transfer or license any rights, in particular copyrights or other intellectual property rights, in connection with a Course to you. All intellectual property rights in and to the Course, the Course content, and all materials accessible via the Website or in connection with the Course are owned by ESCMID or licenced to ESCMID, unless you are the author and/or speaker. You shall not reproduce or allow anyone to reproduce any intellectual property right of ESCMID, including but not limited to trademarks or materials, accessible by or on behalf of ESCMID at a Course for any reason, without the prior written permission of ESCMID.
Nothing in these Terms shall grant you any legal or beneficial right to any intellectual property rights owned or used under licence by ESCMID, nor shall it grant you any right or licence to any other intellectual property rights of ESCMID. All such rights shall remain the exclusive property of ESCMID.
If you are a speaker or moderator, you remain owner of the intellectual property rights in your content and you herewith grant to ESCMID at no cost, a perpetual, unlimited, non-exclusive, worldwide, irrevocable, royalty-free, transferable, sub-licensable, fully paid-up licence, to use all intellectual property rights for any purpose whatsoever, but always limited to the marketing purposes in the scope of ESCMID's business activities. You hereby agree to give, also after the Course, all necessary declarations and to perform any actions, which are necessary to implement the assignment or license grant as set out in this Section, including, but not limited to deliver any documents or content, etc.
When you register to participate or attend a Course, you understand that ESCMID processes the personal data that you have provided during the registration process such as your name, date of birth, e-mail address, confirmation that you are a prescriber (if applicable), data related to your payment, and affiliation, in its IT systems (including a CRM) for the purpose of organising, promoting, and executing the respective Course or related services. Within the registration process, you can agree that ESCMID uses your personal data to inform you about future Courses and to send you information provided by industry partners (without sharing your personal data with any industry partners).
You understand that certain Courses are provided by industry partners and only when you attend such Courses you agree to share your personal data with the industry partner providing the Course. If you do not agree to such data processing, please choose another Course. Before entering the Course of an industry partner, you will be reminded that your personal data will be shared. Courses may be filmed and recorded. In this case they will be accessible through the Website or in any other form as defined in the description of the Course or as informed by ESCMID.
The organisation of Courses involves the participation of IT and other providers, as well as subcontracting agreements, such as for Course locations, conferencing tools or similar.

ESCMID does not warrant the completeness, accuracy and actuality of the information, video presentations, discussions, sessions, material, abstracts, or any other materials provided or accessible at a Course or through the Website, in particular not the medical information.
Video presentations, discussions, sessions, or any other materials provided or accessible at a Course or through the Website in connection with a Course are intended for information purposes only and should not be relied upon by you or others.
You acknowledge and agree that views expressed by speakers, chairpersons, or any other attendees or participants at or in connection with a Course are their own and ESCMID does not accept any responsibility or liability for any advice given or views expressed during or in connection with a Course.
To the extent permitted by applicable law, ESCMID disclaims all warranties or conditions, either expressed or implied, or any part of them in respect of any aspect of a Course or any related video presentations, discussions, sessions, or any other materials provided or accessible at Course or through the Website. You acknowledge and agree that in accepting these Terms you have not relied on any representation or warranty that is not expressly included in these Terms, and you agree that you shall have no remedy in respect of any misrepresentation which has not become a part of these Terms.
To the fullest extent permitted by applicable law, ESCMID excludes any liability for any damages, loss, injury, or liability whatsoever suffered out of or in connection with a Course and these Terms. Nothing in these Terms purports to exclude or limit liability for gross negligence or wilful intent or in respect of any liability that cannot be excluded or limited under applicable law.
You agree to defend, indemnify, and hold ESCMID and its third-party service providers, respective employees, contractors, officers and directors harmless from all claims, liability, damages, losses, costs and expenses, including legal fees, that arise out of or are related to any breach of the Terms by you or any other liabilities incurred by ESCMID due to your attendance or participation at a Course, for example, any content you provide or questions you pose during a Course.
ESCMID is not liable if any Course for which you have registered is cancelled, rescheduled or postponed in whole or in part, or if ESCMID fails or delays in performing any of its obligations under these Terms, if such an event results from anything beyond ESCMID’s reasonable control, such as natural disasters, floods, riots, fires, acts of terror, war, labour strikes, extreme weather, communicable diseases such as epidemics or pandemics, malicious damage, compliance with any law or government order, mechanical, electronic or communication failures or degradations, or any other emergency. ESCMID is also not liable if any of the Courses become impracticable, illegal or impossible to perform in whole or in part. Section 4 remains reserved.
You have the right to withdraw from your registration agreement without giving any reason within 14 days after conclusion of the agreement, i.e., when you have paid your registration fee and received the confirmation email.
To exercise your right of withdrawal, you must inform ESCMID by sending an email, letter, telephone, or the attached form (European Society of Clinical Microbiology and Infectious Diseases (Europäische Gesellschaft für klinische Mikrobiologie und Infektionskrankheiten), Aeschenvorstadt 55, 4051 Basel, Switzerland, email: info(at)escmid.org, telephone: +41 61 508 01 53). To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal to the addresses provided in this Section 10 or to call us before the cancellation period has expired. You may not withdraw from the agreement if you have already attended a Face-to-Face Course or the Online Course. The right of withdrawal is furthermore excluded for On-Demand Courses, as the digital content is made available to you immediately upon conclusion of the contract.
If you withdraw from your registration, ESCMID will reimburse all the registration fee for the booked Course. ESCMID will reimburse you no later than 14 days after ESCMID was informed about your decision to withdraw from your registration. The reimbursement will occur by the same means as your payment.
By registering for an On-Demand Course, you agree that ESCMID will provide you with the digital content immediately upon conclusion of the contract. You also acknowledge that you will not have the right to withdraw from this contract under Section 10.
These Terms constitute the entire agreement between ESCMID and you with regard to their subject matter and supersede any previous agreement or arrangement between the parties relating to the same subject matter.
Should any provision of these Terms become invalid or ineffective in whole or in part, such provision shall not affect the validity and effectiveness of the other provisions of these Terms and shall be replaced by a provision that reflects to the fullest extent possible the original intention of the parties and the economic purpose that the parties intended to achieve with such provision.
These Terms shall be governed and construed in accordance with the substantive laws of Switzerland (to the exclusion of Swiss private international law and of international treaties). Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of the City of Basel, Switzerland.
